Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Winedow mobile application, website, and related services (together, the "Service"). The Service is operated by Jason MacLeod, doing business as Winedow ("Winedow", "we", "us", or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Winedow lets you scan a restaurant's wine list with your device and view photos and information about the bottles to help you choose what to order. Winedow is an informational and entertainment tool. We do not sell, serve, or deliver alcohol, and we are not a party to any transaction between you and a restaurant or merchant.

2. Eligibility

You must be of the legal drinking age in your jurisdiction to use the Service. By using Winedow, you represent that you meet this requirement and that you will use the Service in compliance with all applicable laws. Please always drink responsibly.

3. Accounts

Some features may require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@getwinedow.com if you believe your account has been compromised.

4. Freemium and Subscriptions

Winedow is offered on a freemium basis. Certain features are free, while others require a paid subscription or in-app purchase ("Premium Features"). Pricing and included features are presented in the app at the time of purchase.

Purchases and subscriptions are processed by Apple through the App Store and are subject to Apple's terms.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
You can manage or cancel subscriptions in your Apple ID account settings.
Except where required by law, payments are non-refundable. Refund requests are handled by Apple.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms;
Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
Interfere with, disrupt, or place undue load on the Service or its infrastructure;
Scrape, harvest, or misuse data, images, or content from the Service;
Use the Service to infringe the intellectual property or other rights of any third party.

6. Content and Accuracy

Wine images, descriptions, names, vintages, pricing, and availability are provided for convenience and may be incomplete, outdated, or inaccurate. Wine labels, brand names, and trademarks are the property of their respective owners. Winedow does not guarantee that a scanned wine matches the bottle shown, and you should confirm details with the restaurant before ordering.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by Winedow and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that information shown will be accurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINEDOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50.

10. Indemnification

You agree to indemnify and hold harmless Winedow from any claims, damages, or expenses arising out of your misuse of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time by deleting the app.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator of Winedow is established, without regard to its conflict of law provisions, except where local consumer protection laws require otherwise.
